1. Key Terms and Definitions

  • "Livmore" refers to Innolife Solution Co., Ltd, a business registered at 1700 Plan B Tower, New Petchburi Road, Makkasan, Ratchathewi, Bangkok, Thailand.

  • "Livmore Research" means scientific research conducted by Livmore and TruMe Labs (TRUME INC., 7220 Trade St. Ste 170, San Diego, CA 92121, USA) with the intent to publish in a scientific journal. This research uses general, genetic, and user-reported information from users who have given informed consent as per the applicable Consent Document. Livmore Research does not include activities related to Product Development.

  • "Product Development" refers to the activities related to developing new products based on aggregated, non-identifiable data from users. This data is used to improve Services and may lead to commercial collaborations with third parties.

  • "Service" or "Services" refers to the subscription-based offerings provided by Livmore, which include the biological age test: a personalized test conducted via a saliva test kit, processed and analyzed by TruMe Lab to determine the user’s biological age; and any Livmore products, a supplement product included and provided as part of the subscription, designed to support a reduce the user's biological age, depending on the package subscribed by the user.

  • "Product" refers specifically to the Livmore Supplement, a food supplement formulated to help reduce the biological age of users. The Product is provided as part of Livmore's subscription-based service and is intended to support users' health and well-being as informed by their genetic and biological age testing results.

  • "User-Reported Information" includes personal health, lifestyle, or environmental details shared by the user during the testing process, excluding genetic data.

  • “Privacy Policy” means the Privacy Policy of Livmore that which explains how personal information is collected, used, and protected and the user must agree to the Privacy Policy before using the Services.

  • "Consent Document" refers to a document that requires users, under the Privacy Policy, to provide explicit consent for the collection, use, and processing of their sensitive personal data of the user or any User Data that may request in the document. This includes, but is not limited to, genetic data, health information, racial or ethnic origin, and other sensitive information. The Consent Document outlines the purposes for which the data will be used and ensures that users are informed and agree to the handling of their sensitive data in compliance with applicable privacy and data protection laws.

2. Data Collection

In order to provide Services, Livmore may collect a personal data collected from users, including:

  • Personal details (name, surname, gender, date of birth, nationality, etc.)

  • Contact information (address, email, phone)

·   Identification and authentication details (username and password)

  • Financial data (payment history, credit card numbers)

  • Survey data (information entered via surveys form while signing in to your Livmore account. Survey information has been used for Livmore Research on the website and system and if you have given consent according to the Consent Document)

  • User-Reported Information (personal health, lifestyle, and environmental details shared during the testing process)

  • Web Behavior Information (data related to website usage, including cookies, browser type, and page views)

  • Aggregated data is Personal Information that has been combined with other users that is used for Product Development. This type of data cannot identify any user identity.

·   Other information that you have given to us.

In addition, Livmore may also collect and hold your sensitive data such as: Health, medical or treatment information; Racial or ethnic origin; and Genetic data.

Your use of Livmore’s Services is subject to the Privacy Policy, which explains how personal information is collected, used, and protected. You must agree to the Privacy Policy before using the Services.

3. Acceptance of the Terms of Service

Your use of Livmore’s Services constitutes a legal contract between you and Livmore, governed by these Terms of Service (“TOS”). By using the Services, including:

  • Submitting a saliva/buccal sample for the biological age test via the DNA testing,

  • Interacting with user-reported information on the Livmore website,

  • Creating and using a Livmore account (even without providing a DNA sample), you accept and agree to these TOS.

The following actions mean you have agreed to use the Services and accept the TOS:

  1. Clicking to agree to the TOS, where this option is provided in the website;

  2. Using the Services (this implies acceptance).

Any updates to the TOS or related guidelines will be posted on Livmore's website, and your continued use of the Services constitutes acceptance of such changes.

4. Prerequisites

You may only use Livmore's Services if:

  • You are of legal age to form a binding contract (20 years or older);

  • You provide your own genetic sample or have the legal authority to submit a sample for another person;

  • You are not prohibited from receiving Services under the laws of your jurisdiction.

5. Services

Livmore offers genetic testing and analysis through its website, including the collection and processing of saliva samples. Livmore’s services are based on the current state of genetic science, which may change over time as research progresses. You acknowledge that:

  • The purpose of Services is for the Livmore Research and to inform such information to you;

  • Services are provided "as-is" and may change or be discontinued without notice;

  • Livmore makes no guarantees regarding the accuracy or completeness of the test results;

  • The Services may evolve, and new features or technologies may require additional fees.

6. Disclaimer

The Product (i.e. Livmore product) is a supplement product that is designed to support the reduction of biological age and improve overall health and wellness. by using the Product, you acknowledge and agree to the following disclaimers:

·   Use at Your Own Risk: The use of the Product is voluntary and at the user's own risk. The Product comes with a detailed manual inside the packaging, which includes essential information of the Product, such as the ingredients and warnings. Users are required to read this manual carefully and thoroughly before using the Product. Livmore is not liable for any misuse or adverse effects arising from the failure to follow the instructions or warnings provided in the manual or outcomes resulting from the use of the Product. Users should discontinue use immediately and seek medical advice if they experience any negative reactions.

 

·       Not Medical Advice: Livmore's services are educational and research-based, not medical advice, nor intended to diagnose, treat, cure, or prevent any disease. Any information or recommendations provided by Livmore, including through the Service or the use of the Product, are for informational purposes only and should not be interpreted as medical advice. Moreover, genetic information is not comprehensive information and should not be solely relied upon for wellness decisions. Users are encouraged to consult with a healthcare professional before starting any new supplement, especially if they have pre-existing medical conditions or are taking other medications.

 

·       No Guarantee of Results: While the Product is designed to support users in reducing their biological age, individual results may vary. The effectiveness of the Product depends on various factors, including but not limited to genetic makeup, lifestyle, health status, and other wellness practices. Livmore does not guarantee specific results from the use of the Product.

 

·       Allergen Warning: The Product may contain ingredients that could cause allergic reactions in certain individuals. It is the user's responsibility to review the ingredient list and consult a healthcare professional if they have concerns about potential allergens or adverse reactions.

 

·       Regulatory Approval: The Product has been approved by the Food and Drug Administration (FDA) of Thailand. However, it has not been approved by regulatory bodies in other countries. Users outside of Thailand should consult local laws and regulations regarding the purchase and use of the Product. Moreover, it is the user's responsibility to ensure that the purchase and use of the Product comply with applicable local laws and regulations in their country or region. Livmore makes no guarantees regarding the legal availability of the Product in all jurisdictions.

 

  • Emotional Impact and Sharing Information: Genetic information can sometimes lead to unexpected results, which may cause emotional distress. Moreover, please be cautious when sharing genetic data with others. Livmore is not responsible for how shared data is used by third parties.

7. Subscription Period and Automatic Renewal

Your membership will automatically renew on a quarterly basis unless you cancel before the end of the current subscription period. The membership fee will be based on the prices in effect at the time of renewal.

To pause or cancel your subscription, you must do so at least 15 days before the next billing cycle.

8. User Representations

By using Livmore's services, you confirm:

·   You understand and thoroughly read this TOS, including its disclaimers;

·       You are at least 20 years old and legally able to provide a genetic sample or authorize the testing of another person's sample;

·   You will not use the Services for insurance, employment, or forensic purposes.

9. Termination

Livmore reserves the right to terminate your account or services at any time if:

  • You breach any part of the TOS;

  • Livmore is required to do so by law or a third-party partnership ends;

  • The Services become commercially unviable in your region.

10. Limitation of Liability

Livmore is not liable for any damages resulting from:

  • Inability to use the Services;

  • Actions taken based on Livmore's information;

  • Unauthorized access to your data.

12. Changes to the Terms of Service

Livmore reserves the right to alter, revise, amend, and modify these TOS from time to time. Any changes will be posted on Livmore's website, and your continued use of the Services constitutes acceptance of the updated TOS.

13. Proprietary Rights

Livmore owns all rights to the Services and Software, including intellectual property rights. You may not modify, distribute, or create derivative works from Livmore’s materials without express permission

14. Governing Law

These Terms of Service (TOS) shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions. Any disputes arising out of or relating to these TOS will be subject to the exclusive jurisdiction of the courts of
